Care for who is hurt, the same rules for everyone, or room for people to choose.

Who is hurt

You start with the person the decision lands on. A fair-looking rule that crushes one group does not get your vote. Harm is not an acceptable side effect.

The miss is a rule so tailored that nobody can tell what it is. Care still needs a sentence other people can apply next time.

The same rules

You want the rule to be the same even when you like the exception. Favoritism feels like rot. You will take a harsher consistent outcome over a kinder uneven one.

The miss is a rule that was written for a life unlike the one in front of you. Sameness is not the same as justice. Ask who the rule was built around.

Room to choose

You want the group to set a floor and then get out of the way. Adults can pick. A decision that manages people’s private choices will grate.

The miss is a floor so low that “room” means the careless people set the terms. Room works when the harm is named first.
